These Terms of Service ("Terms") govern your use of the HiCris website and services. By accessing
our website or purchasing services, you agree to these Terms.
Services
HiCris provides Shopify-related development and support services, including custom development,
integrations, and ongoing maintenance. Services are delivered using pre-paid hours unless otherwise
agreed in writing.
Pre-Paid Hours
- Services are purchased in advance as pre-paid hours.
- Pre-paid hours are valid for three (3) months from the date of purchase.
- Unused hours expire after the validity period and are non-refundable.
- Hours may be used across multiple tasks and requests.
- Hour balances are tracked internally or through the client portal.
Fixed Quotes per Request
- For individual tasks or requests, HiCris may provide a fixed quote based on the estimated effort
required.
- Once a quote is approved, the quoted number of hours is deducted from the client’s available
balance, regardless of the actual time spent completing the work.
- Fixed quotes apply only to the agreed scope. Any changes or additional requirements may require
a new quote.
Requests and Delivery
- Work begins after pre-paid hours are available and a request is approved.
- Start times and delivery timelines are estimates and may vary based on workload and request
complexity.
- Emergency or urgent requests are handled as reasonably possible but are not guaranteed unless
explicitly agreed in writing.
Payments and Refunds
- All payments are due in advance.
- Pre-paid hours are non-refundable.
- No refunds or credits are provided for unused or expired hours.
Client Responsibilities
Clients agree to:
- Provide timely access, information, and approvals
- Ensure they have the rights to any materials provided
- Review completed work in a timely manner
Delays caused by missing information or approvals may affect timelines.
Intellectual Property
Unless otherwise agreed in writing:
- Upon full payment, clients own the custom work created specifically for them.
- HiCris retains the right to reuse general knowledge, techniques, and non-client-specific
components.
Limitation of Liability
HiCris is not liable for indirect, incidental, or consequential damages. Total liability is limited
to the amount paid for the services giving rise to the claim.
Termination
HiCris reserves the right to refuse or terminate service at its discretion in cases of policy
violations, non-payment, or abusive behavior.
Third-Party Services
HiCris may work with or integrate third-party services. We are not responsible for their
availability, functionality, or policies.
Changes to These Terms
These Terms may be updated from time to time. Changes will be posted on this page with an updated
effective date.
Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law
principles.
